Unauthorized duplication may result in severe criminal and civil penalties and will be prosecuted to the maximum extent of the law. Without additional purchase or license, software may be installed onto only one single computer, or installed onto two computers that are operated by one single user. You agree not to redistribute, sell, decompile, reverse engineer, disassemble, or otherwise reduce software to a human-readable form. All parts of software and software design are copyright protected.

Agreement to Use Software Lawfully: You agree to use software in a responsible manner, limited to legitimate purposes only (such as increasing online PRIVACY, or testing of geo-targeted marketing campaigns). Software is performing a simple function that is made possible by Microsoft in the Internet Explorer browser, and by Mozilla in the Firefox browser. However, software, like any other tool, has the potential of being misused. You agree that your use of software will be in compliance with all Local, State, and Federal laws. Regardless of your local laws, you agree not to use software to send any type of unsolicited or bulk email, violate another website's terms of use, commit fraud, or for any other illegal or malicious purpose. You agree to familiarize yourself with all relevant issues and requirements, and to ascertain the applicable laws in your area, before installing or using software. If you are unaware of the applicable laws or unsure of your responsibilities, you agree to consult with a qualified legal advisor (attorney) before proceeding with this purchase. While we firmly believe in the Internet user's right to privacy, any use of software for illegal or malicious purposes is a violation of this agreement and our terms of use. Any user who commits any kind of criminal action through use of software surrenders any and all legal rights to privacy, protection, confidentiality, or anything else that a legitimate user of software could normally expect. You understand and agree that we may disclose any and all information available including your true IP address, account history, and other information to any law enforcement agency that requests such information via a proper court-approved subpoena, without your consent or notification.

Limitation of Liability: The developers, owners, and distributors of this software are not liable for any violations by you, or losses incurred by you as a result of using the software. You agree to indemnify, defend and hold the owners of this software harmless from and against any and all claims, damages, losses, costs, attorneys' fees, or other expenses arising from or in any way related to, your use of this software.

Software is Provided Without Warranty: While reasonable efforts are made to deliver high quality products, we do not guarantee software to be free from defects. The software is provided "as is", and you use the software at your own risk. We make no warranties as to performance, merchantability, fitness for a particular purpose, or any other warranties whether expressed or implied. Under no circumstances shall owners of software be liable for direct, indirect, special, incidental, or consequential damages resulting from the use, misuse, or inability to use this software, including without limitation, lost revenues or lost profits, even if owner has been advised of the possibility of such damages. You are solely responsible for adequate protection and backup of the data and equipment used in connection with this software.

Payments and Fees: Software purchase is a one time fee, and comes with 3 months of customer service and proxy setting updates. After 3 months, you may continue using the software with no additional charge by entering settings yourself using the provided instructions.

Feedback or Submissions: Unless specifically provided otherwise by owners, all feedback or submissions of any kind submitted to this Web site via contact form or email become the property of owners, to be used or not as owners choose without cost or liability.

Severability: If any provision of this agreement shall be held to be invalid or unenforceable for any reason, it is, to that extent, deemed omitted and the remaining provisions shall continue to be valid and enforceable.

Applicable Law and Venue: The formation, construction, and interpretation of this agreement shall be controlled by the laws of the State of California, U.S.A, as such law applies to agreements between California residents entered into and to be performed within California. Any dispute relating to this agreement shall be subject to the exclusive jurisdiction of the state and federal courts in San Francisco County, State of California, U.S.A., and you agree to submit to the personal and exclusive jurisdiction and venue of these courts. You agree that your dispute will not be heard by a jury and may not be made part of a class action.

Amendments:

If you sign up for this service with a stolen credit card or PayPal account, you will forfeit all rights to privacy, and your activities will be reported to YOUR local law enforcement and your ISP. Illegal activities are not welcome, and a fraudulent registration is an indication of fraudulent intentions. (Added November 17, 2008)
